Suicide Vs Crime

A person kills himself. What will you call him, a victim or a convict, or just a criminal? Well, our legal system will treat him as a criminal. Suicide is crime, where its subject and object, both is one.

No doubt, a person who does suicide does a crime as he is not only one who has got privilege to his life. His parents, his wife, his family and even, his nation have equal right over his life. He owes to his family, his nation and putting an end to his life is like escapism from his responsibility; his duties.

People take their life so seriously that their seriousness takes their life. A love betrayal, failure in academics and business, death of some loved one, frustration from boring life are some of its reason but the core of every reason is converged on one fact that every people who follow this heinous attempt, are  ailed with terrible hatred and abhorrence towards life. The life, which was once bloomed with love and innocence, ruins into the labyrinth of hate, distress and melancholy, and concludes with a suicide.

“Some time back, a 24-year-old resident of Delhi committed suicide by hanging herself. She had been married for barely a year and had a month-old baby. Her in-laws were arrested for harassing her for dowry. But had the victim survived, along with her in-laws, she too would have faced a prison term and perhaps, even a fine. In the eyes of the law, she would have been a criminal for attempting suicide. That's what Section 309 of the Indian Penal Code (IPC) says.”

If a person kills someone, he/she is punished. But when a person attempts suicide, he/she is also punished. In former case punishment creates fear and prevents other people to follow him. But in the latter case, fear is inept to prevent suicide as a person who attempts suicide, never thinks that he/she will not die. The hatred of life and desire of death overweight the fear of punishment. How absurd it is, when, in our constitution, a person who attempts suicide has to be punished by court when he/she is already facing traumatic mental suffering from the people and society. Do you not think it will just lead him/her another suicide? Jail or bars can prevent you to killing others but what about killing yourself.

What are the fundamental flaws that are responsible for suicide and How can it be prevented is an issue of great concern. Well, faith in a supreme being; an optimistic view; courage are some of the attributes who can sprinkle the sense of love in your barren life. But development of wider and spiritual attitude towards life provides you a life, malleable and amenable where no disaster can break your consciousness. And in this development, no one can have so much impact, as a Teacher can have. The greatest aim of teacher is to teach how to love one’s life; how to respect one’s being; how to face the disaster with courage. An education system without such teacher can only create Zombies.

Ia person kills he/she is punished..But that is after sometime he commits the crime..

But when one commits a suicide he/she is punished instantaneously...

Suicide is the act of the coward...Those who cannot face the challenge will commit suicide...

The fundamental flaw is the minds of the person who commits suicide..

May be the concept of success and failure is also a main reason for the suicide...

For eg:failure in a exam..failure in love..etc..etc... These can be viewed as fundamental flaws..

In my opinion,no law is good enough for this crime. Suicide is a state of mind and happens in a fraction of a moment when one is in depression.But if the person survives,he/she needs treatment and not punishment.

hey Amit and Shankar, somehow i don't agree with you that if a person tries to commit suicide, he/she is a coward. It's very easy to say that its a cowardice act. I believe that whosoever tries to commit suicide, he does this because of immense depression and stress.and when a person is depressed he/she loses his/her power to think and reasoning.For example, Everybody knows about the situation of farmers who are committing suicide every now and then in India, you cannot call them cowards for this act of them..
They are poor and have large families to support, when they find themselves unable to feed their family then the thoughts of their loved ones being starved to death in front of their eyes starts haunting them, which further results in depression.
The only way they can think of to escape this plight is suicide..they lose the ability to think that after their death the family will starve to death too..

just for once think about it, just put yourself in their place and then think..you will get the answer. Even i used to believe that only cowards do such things but with the passage of time i gradually changed the way i think..that's all i wanted to say...

It was a brave topic for such an young writer. Very impressive.

In my viewpoint, the person who commits suicide or attempted suicide is a victim. Rather than punishing him, we should try to understand why the person was driven to it. This will help us in preventing such incidents in the future.

Well, you are true that the generalization of suicide with a term 'coward' is not is not appropriate. While I was writing this post once I have thought about the suicide of farmer and yes, I agree that we cannot say they are coward.
But , just contemplate the situation when an Engineering/medical student does suicide due to his failure in his exams; a 10th class girl suicides becoz of being failed; a lover suicides due to the betrayal of his counterpart; a business man does suicide; an Hollywood or Bollywood actor/actress suicides for whom money, hunger does have no value.
Do you call him brave? They are terribly scared for their future, from the society; even, from self that they lost all their hope and when they should face their hardships with patience, courage and optimism they exaggerate their fear which leads them to suicide.
Well, cases of suicide due to hunger and poverty are very less compared to other cases as I have explained above. But I do not mean that they are not of concern but they need other solution (money etc)
Yes, they are in great depression. But their depression is just consequences of their fear, which kills their reasoning.

To a great extent I feel, suicide without cowardice is called sacrifice...(like Bhagat singh, Chandrasekhar Ajad)

Amit:- Thanks for replying. See when students commit suicide, then money and hunger has no value;i agree to this point of yours, but in a society where parents want their kids to be all rounders and get only more than 90% marks, if a kid fails he thinks that he is a loser and peers and parents also leave no stone unturned to make him feel inferior..then again he turns to things like drugs to release stress and if it does not work out then he chooses suicide. I don't know that why getting high grades is the only standard to measure the ability of an individual in our country?

and so far as film stars are concerned, they have a habit of being in limelight 24X7, when it is snatched away from them they just can't take it.
Take one more case. Though it might seem gross to some. When a women is raped, she is looked down upon by everybody, some parents don't even let her lodge a complaint and keep saying that she is having ill luck and that she is a burden, then that women thinks that its better to end her life; and even those women who protest, all they get is bad name for them and their family even though they are the victims and not the culprit. In such situation its not money and hunger but its society who forces one to commit suicide..

It seems to me that when one resorts to such option, its not all his/her fault, somewhere the people around him/her are also responsible either directly or indirectly..

But More or less for every crime, only convict is not responsible, people around him; circumstances behind him is directly or indirectly is also accountable.

Well, if we have to look for its solution, it is a herculian task to change the society but one can change oneself. for this development of right attitude and potential to face the society is inevitable.....

we say the people who commit suicide are the one who dont have enuf guts to face lyf n its hardships...but to harm ur ownself isnt that easy either...u really need guts...so wat stands true...
n moreova our law is so crippled that they dont even try to rectify or work for humanity...n its not only with the law its with most of us...v lyk reading such articles n news but wat do v really do...how v help ppl..how bothered r v?

well, u r right .. How much people are scared of death, tell us how much guts are required to even kill himself. Even a person, in his most suffering condition do not want to die.. otherwise no cripple person can be found in fron of temples and railway platforms.

Now, I think when hatred towards life overweight fear of death, suicide occurs.
And why does this hatred stem... somewhere i feel, he/she are suffering with fear of different forms in different cases. This fear kill their reasoning when reasoning is lost, a slight emotional triggering lead him to suicide.
Do you not think, it is easy for blind/deaf man to cross a deadly road... Can we define it his courage?

Well, I am totally agree with you that our law is crippled, as when a man require sympathy and emotional healing, it provides punishment.

Well i feel motivation and development of spiritual attitude may be its one of the solution... And fundamentally only proper education can foster this attiude in our minds...

I actually have a friend you just died April this year and yes he committed suicide. it was awful, painful. You know whats more painful? its the saying that goes"A person who considers committing suicide is someone who is deprived of ... something, may it be love, attention, or acceptance. The point is sometimes, society is also held liable for a person who is resorting to taking his own life. " And what can I say? i have been useless as a friend.

Really I am feeling extremely sorry for ur friend...As I have really witness such incident in my life(though they are not so close to me)...It feels really terrible....But we have some constraints and at best we can try with full effort to prevent such acts...

When anyone, who preferred death as the solution to all his/her problems, escapes the suicide, I would suggest punishment is not all he / she deserves. As I read somewhere, when the suicider possess such a courage to take his life off, with that much valor he would have come over his problems.

I totally agree with you. Suicide as Psychology understands it is nothing but "aggression turned inwards".

If I am not wrong, most people have thought about suicide at some point in their life or the other (and many might have attempted it even) !!.

I don't think, this law can help "preventing" any suicides !! It is very unlikely that a person in that frame of mind will consider what the law has to say... so it doesn't help I think.
